Spell Surge Terms of Service

These Terms of Service ("Terms") govern your use of Spell Surge ("the Game"), developed by FatyFlyns Studios.

By downloading, installing, or playing Spell Surge, you agree to these Terms.

1. License

Spell Surge is licensed, not sold.

FatyFlyns Studios grants you a personal, non-exclusive, non-transferable license to install and play the Game for personal entertainment.

You may not:

Reverse engineer the Game
Redistribute the Game
Resell the Game
Modify the executable
Remove copyright notices

Unless expressly permitted by applicable law.

2. Mixed Reality Safety

Spell Surge is a physical Mixed Reality experience.

Before playing you should:

Ensure your play area is free of obstacles.
Keep pets and children away from the play area.
Remove fragile objects.
Maintain awareness of your surroundings.
Follow all Meta Quest safety guidelines.

Players are responsible for their own physical safety while using the Game.

3. Multiplayer

Spell Surge supports Local Area Network (LAN) multiplayer.

Players are expected to behave respectfully toward others.

Any attempt to intentionally disrupt gameplay, exploit bugs or modify the software may result in future restrictions if online services are introduced.

4. Voice Commands

Spell Surge allows spell casting through voice recognition.

Voice recognition is processed locally on the headset.

Voice recordings are not stored.
Voice data is not transmitted.

5. Availability

FatyFlyns Studios may release updates, improvements, balance changes, bug fixes or new content at any time.

Certain features may change or be removed in future versions.

6. Intellectual Property

Spell Surge, its logo, artwork, visual effects, audio, source code and original assets are the intellectual property of FatyFlyns Studios, unless otherwise noted.

Third-party software remains the property of its respective owners.

7. Third-Party Components

Spell Surge incorporates open-source and third-party software under their respective licenses, including:

Unity Engine
Meta XR SDK
Unity Transport
Netcode for GameObjects
Vosk Speech Recognition

8. Warranty Disclaimer

Spell Surge is provided "AS IS" without warranties of any kind.

FatyFlyns Studios makes no guarantees regarding uninterrupted availability or error-free operation.

9. Limitation of Liability

To the maximum extent permitted by applicable law, FatyFlyns Studios shall not be liable for:

Indirect damages
Incidental damages
Loss of data
Loss of profits
Injuries resulting from unsafe play areas or misuse of Mixed Reality devices

Players assume responsibility for using the Game safely.

These Terms may be updated periodically.

11. Governing Law

These Terms shall be governed by the laws applicable in Mexico, without regard to conflict of law provisions.
